Prevention is better than cure. The ‘compliance’ function has become an indispensable part of the business operations of every financial company. Increasingly, financial companies must implement laws and regulations, establish measures and procedures to comply with internal and external rules and adequately train and instruct their staff. Regulators are increasingly investigating the functioning of the ‘compliance’ function and checking whether financial companies have complied with their public law regulations in time. Financial companies are increasingly confronted with situations in which it seems as if they have to prove that these public law regulations are being complied with.
